KOOKAÏ Privacy Policy

It is important that you read this Privacy Policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal information about you so that you are fully aware of how and why we are using your information. This Privacy Policy explains how personal information will be treated as you access and interact with KOOKAÏ.

If you are under 16, please make sure your parent or guardian reads and explains the following information to you, and consents to the terms of our Privacy Policy on your behalf before you provide us with your Personal Information. If you are under 13, you must not provide us with your Personal Information.

  1. KOOKAÏ’s Privacy Obligations

The websites www.kookai.com.au, www.kookai.co.uk, www.kookai.us, and www.kookai.co.nz (the, ‘Websites’) are operated by or on behalf of Magi Enterprises Pty Ltd ABN 491 544 236 13 or entities within the KOOKAÏ corporate group  as listed in clause 14 below (‘Related Entities’), trading as 'KOOKAÏ' (‘KOOKAÏ’, ‘we’, ‘us’ or ‘our’). KOOKAÏ is the controller responsible for your personal information. A reference in this Privacy Policy to KOOKAÏ, we, us or our also refers to our Related Entities.

KOOKAÏ respects the privacy of your personal information as a visitor to the Websites and is bound by the Australian Privacy Principles under the Privacy Act 1988 (Cth), the Privacy Act 1993 (NZ), the Personal Data Protection Act  2012 (SG) and the Personal Information Protection and Electronics Documents Act (CA) (together, the ‘Acts’) the Data Protection Act 2018 (UK) and the General Data Protection Regulation (together, the ‘GDPR’) and other laws which may be enacted to protect your privacy from time to time. 

All personal information held by us will be governed by our most recent Privacy Policy, posted on the Websites. We will post any changes to this Privacy Policy on the Websites, including to take into account new laws, regulations, practices and technology. Please check this Privacy Policy for updates from time to time. In addition to the Privacy Policy, there may also be specific and additional privacy provisions that apply to certain sections of the Websites and/or your interactions with KOOKAÏ – you should read and consider these wherever they appear. Your name, age, postal and email address, phone number, payment details (such as your credit card details and billing address) and video surveillance recordings or still images of you as well as your resume, skills, qualifications and residency status are examples of personal information.

  • In accordance with this Privacy Policy or any agreement you enter into with us; or
  • Required or authorised by law, including without limitation under the Acts and the GDPR.

KOOKAÏ may disclose, or provide access to, your personal information to third parties in connection with the purposes described in 2(b) of KOOKAÏ’s Privacy Policy.

We may disclose your personal information:

  • To third party service providers appointed by KOOKAÏ to perform services for us or on our behalf (such as order fulfilment, reference and police checks, website and data hosting providers, payment processing services and PR agencies);
  • To Related Entities;
  • As required or authorised by law;
  • To third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets; or;Otherwise with your consent.

We require all third parties to respect the security of your personal information and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

For visitors to the Websites located in the European Economic Area (‘EEA’), your personal information will be transferred outside the European Economic Area (‘EEA’).

KOOKAÏ, its Related Entities and some of our third-party service providers may be based outside of the EEA.

Whenever we transfer your personal information out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We transfer personal information pursuant to binding corporate rules of KOOKAÏ and its Related Entities.
  • We use specific contracts, or data protection clauses, which have been adopted or approved by the Information Commissioner’s Office or the European Commission which give personal information the same protection it has in Europe.

  1. Children's Privacy

(a) The Websites are not intended for use by children. KOOKAÏ is committed to protecting the privacy and safety of children. The Websites are a general audience site and children under the age of 13 are prohibited from using the Websites. We will not knowingly collect any information from children under the age of 13; nor will we knowingly send any email correspondence to children under the age of 13. If we learn that we have collected information from a child under the age of 13, we will remove that information immediately and delete it . Children under the age of 13 should always ask their parents or guardians before providing their information online. (b) California Minors
. We may provide users of the Websites the ability to publicly post information, for example by submitting photographs or other User Content. If you are a California resident under age 18 and you are unable to remove publicly-available User Content that you have submitted to us, you may request removal by contacting us at: legal@kookai.com.au When requesting removal, you must be specific about the information or User Content you want removed and provide us with specific information, such as the URL for each page where the information is located, so that we can find it. We are not required to remove any User Content or information that: (i) federal or state law requires us or a third party to maintain; (ii) the User Content or information was not posted by you; (iii) we anonymize the User Content or information so that you cannot be identified; (iv) you don’t follow our instructions for removing or requesting removal; or (v) you received compensation or other consideration for providing the User Content or information. REMOVAL OF YOUR USER CONTENT OR INFORMATION FROM THE WEBSITES DOES NOT ENSURE COMPLETE OR COMPREHENSIVE REMOVAL OF THAT USER CONTENT OR INFORMATION FROM OUR SYSTEMS OR THE SYSTEMS OF OUR SERVICE PROVIDERS. We are not required to delete the User Content or information posted by you; our obligations under California law are satisfied so long as we anonymize the User Content or information or render it invisible to other users and the public.

  1.  California Shine the Light Law

California Civil Code Section 1798.83 permits California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed personal information (as defined under that statute) of that California resident, for direct marketing purposes in the preceding calendar year and the categories of that kind of personal information that was disclosed to them.   1. Security of personal information

Irrespective of whether personal information is stored electronically or in hard copy form, KOOKAÏ will take reasonable steps to protect the personal information we hold from misuse, interference, loss, unauthorised access, modification or disclosure. However, except to the extent liability cannot be excluded due to the operation of statute, we exclude all liability for the consequences of any unauthorised access.

In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

You have the right to:

Request access to your personal information. This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected, though we may need to verify the accuracy of the new information you provide to us.

Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal information to comply with local law.

Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

   9. No Fee Usually Required

    You will not have to pay a fee to access your personal information (or to exercise any of the other rights listed in clause 5). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

    1. What We May Need From You  

    We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our responses.

    1. Time Limit To Respond  

    We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
